  • 5/11/21:
    City Council Meeting: Council Members and the Mayor unanimously vote to work with Tejano BMX Trail volunteer group to preserve the trails!

    The following was the direction given to city staff:
    “Direct staff to work with the Tejano BMX Trails volunteer organization to develop a plan for the BMX trails on City parkland for Council consideration, ensuring compliance with all applicable federal, state & local laws and regulations, and to continue to allow public use of the BMX trails pending plan development, provided all improvements, equipment and materials are removed from the site with the exception of the dirt ramps.”

    City of Pflugerville Parks Staff make surprise visit to Tejano BMX Trails.
    City Staff talk with lead volunteers, Desmond Startin and Robert Ball about their visit. City Staff mention upcoming park projects and potential concerns with accessibility and water intake. Make no mention of flood plain issues and potential shut down of the trails.

    2/4/2015:
    City holds public meeting to discuss a volunteer installed comination locked access gate to the Pro Lines/ big jumps for rider safety. The purpose of this gate was to to ensure rider safety, with the reasoning that riders jumping huge jumps shouldn't do it alone in the event of a bad wreck. Having other riders present provides safety support.

    The resistance to the gate came from a single individual operating BMX training classes for profit on city property. The outcome of the meeting was that the gate was allowed to remain intact.

    Current state: As trail safety and safety awareness has improved, the gate has been removed.

    August 11, 2009: (Official City Council Discussion Notes)
    B. Youth presentation regarding a successful cooperative project with the City for the establishment of a BMX bike track. Mr. Gonzales provided information on the project and the work done to create the BMX bike track. He stated that over 600 hours had been spent in working on this project and they are continuing to work on it. He commended the young men for taking the initiative to make something for their enjoyment and physical fitness. He stated that it has benefited them and now benefits the City of Pflugerville. Mr. Gonzales recognized three of the young men that worked on the project who were in attendance: Steven Gonzales, Alan Evans, and Armando Flores. Mr. Gonzales stated that he is excited about the cooperation that they have had and that he hopes this is a project that continues. He suggested a possible community BMX bike event in September or October. He stated that it is accessible by a safe route from the trail system and is a fun place to be. Mr. Gonzales noted his pride in the young men that made it happen.

    July 28, 2009: (Official City Council Discussion Notes)
    D. Discuss and consider action regarding future agenda items. Mr. Gonzales requested an item to recognize a group of teenagers that recently established a BMX bike trail on City land. He noted that it was an impressive project that evolved. Mayor Coleman asked that the group give a five - minute presentation on the project. Mr. Gonzales stated that Mr. Hurta had suggested dual use of drainage ditches to provide skating facilities and he would like to look at that. Ms. Gillam stated that staff has started to look at that and will provide a report. CEVM sign changes to the sign ordinance was noted as an item.

    I will refine and share (ASAP) my presentation based on our conversation yesterday prior to the city council meeting to get your input and feedback on delivery of a successful message to save TBT.
    Comment / Question:
    As it seems the floodplain was the biggest initial concern, I think it would be advantageous for your team to mention recent findings from the re-evaluation of the flood model by the civil engineer stating his findings of:
      1. The jumps not being located in the flood flow area
      2. The jumps not affecting floodplain storage
      3. The jumps presenting minimal erosion concerns
      4. There is data to support these findings

Staff feels this is a balanced approach to protect city taxpayers from liability and preserve access to the trails while we continue to work on this project.     Agenda Summary
    Over the last 12 years, community volunteers have invested thousands of hours creating a series of BMX trails on City parkland located within a wooded area southeast of E Pecan Street and Plumbego Drive. While there have been discussions in prior Council meetings as early as 2009, the City has not taken any official action regarding the use of this area, regulated its activity, nor been involved in its development. However, given the extent of the current improvements, its location within the floodplain, and the potential liabilities associated, city staff felt it necessary to seek direction from Council regarding the future of this property.

    There are several issues with the current improvements to the site related to the location within floodplain, unsafe structures, emergency response, and water sources. However, city staff feels there could be solutions to address these concerns and would like the opportunity to work with the Tejano BMX Trails (TBT) organization to develop a plan to mitigate these concerns and ensure compliance with all applicable federal, state and local laws and regulations. TBT has also expressed a desire to utilize their resources and professionals within their organization to perform as much of the work as possible in an effort to minimize any potential investment from the City. By working together, we could determine what TBT can address on their own, what the City would need to invest, and then present a plan to Council for consideration.

    While a plan is being developed, it is recommended that certain actions be taken to mitigate as much potential liability as possible while preserving public access to the trails. With this is mind, staff recommends that TBT and the City work together to remove all improvement to the site (wooden platforms, cinderblocks, water tanks, benches, etc.) but leave the trail and dirt ramps for patrons to enjoy. Once a plan is developed and approved by Council, we can look to reinstate some or all of these elements ensuring proper construction and compliance with applicable laws and regulations.

    I can schedule time off from work for a meeting but would like a few of our volunteers to join but doubt they can make it due to work conflicts.
    If we can have an agenda sent prior to the meeting I could gather their input and questions.
    If you could incorporate our items below into your agenda I can gather feedback from our group prior to the meeting.
    Agenda:
    Floodplain concerns: 
    After reviewing our seasoned Civil Engineer / Flood Modeling SME's assessment, when and who will make an evaluation on the flood plain concerns?
    We need acceptance of accurate data on the jump locations to support any flood model decisions.
    Surveying:
    Our surveyor and his firm have offered to conduct a licensed survey.
    The city would need to produce any specific requirements for the survey outside of the normal scope of a survey.
    Knowing our group has limited funds to pay for the survey, the scope of the survey needs to be defined prior to initiation.
    Will the city be bound to accept a survey conducted by a licensed firm initiated by our group or will the city require they use their own survey firm?
    City Council meeting 5/11:
    Is this one city council meeting the final point of action for Tejano BMX Trails?
    Should/can we postpone this item on the 5/11 agenda until we have a determination on the flood model assessment and possible survey?
    City Council meeting details:

    • Presentation delivery format: Browser based web delivery, PowerPoint.PPT, etc..?
    • Speaking time: Can others sign up to speak and donate their time to me? Is there a max speaking time available?
    Non Profit 501c formation:
    Our group has initiated 501c formation, we would like to know ASAP if we have a chance to work with the city to save the trails prior to completing the process and completing payment of near $1000.

    One of our Lead Volunteers and professional Civil Engineer, Marty Christman (CCd) completed his review of the floodplain hydraulic model.
    I believe he used LIDAR data to accurately place the jumps/trails location which mirror the jumps location via GPS data I sent prior to this email.
    Slides 12, 13 & 14 summarize his findings:
    Slide 12 Floodplain Storage:
    • Trails are situated on terrain above elevation 646 and below 654 in the floodplain.
    • Jumps created by excavating shallow pits and stacking and shaping soil into ramps and landings.
    • Trail features (jumps) were created without importing fill, so floodplain storage is not impacted.
    Slide 13 Flood Flows:
    • Trails are outside floodway and located in ineffective flow area
    • Located in area of scattered brush and heavy weeds (n = 0.07)
    Slide 14 Erosion:
    • Clay rich soils with cohesive properties
    • Exposed soil surfaces on trails and jumps is highly compacted by bike tires
    • Tarps used to cover exposed dirt mounds in event of heavy rain
    • Grass and vegetation planted on steep slopes on sides of features to hold soil in place
    • Above conditions tends to prevent soil erosion
    • When erosion does occur, sediment is captured in shallow pits (sediment traps) near jumps.  No sediment is discharged to the creek.
    Please let me know your thoughts on how we should proceed concerning:

    1. Do you have any update on the city's position on this issue after our initial meeting and further input? 
      • (We would like to know if we have any options on the table to come to a consensus & work with the city to save the trails for the benefit of the community before we put in the effort and money to pursue the items listed below)
    2. At what point will it be most effective to produce our documentation of community support?

    Additional comments:

    1. Please note, we have disabled the water intake system and if we are not able to obtain a TCEQ permit or other solution we will remove the water tanks from the site.
    2. Same with the roll in/start deck, if we are not able to obtain a permit to modify the existing structure we would gladly submit a design up to code to obtain a permit for a new structure and remove the old structure.
      • If neither option is viable, we will remove the structure in a reasonable time frame.
    3. We have begun the legal process of filing a 501c Non Profit application.

    Prior Conversation:

    1. I forgot one of our community volunteers is an Attorney for TCEQ.

    He mentioned we may want to request an official hearing pursuant to the Texas Administrative Procedures Act prior to further action on this issue.

    This would buy us time to gather more info & refine our approach prior to a City Council meeting.

    Do you think this is a viable positive option for our group?  -TM

    Would this be regarding the pumping of water directly from Gilleland Creek? 

    If so, we would be happy to discuss this issue with the Attorney and understand what action they recommend. Are you hoping to obtain permission from TCEQ to pump water from the creek?- JH

    The official hearing request is an option to buy us time as this shut down seems a high priority per our last meeting.

    Depending if you can provide guidance as to the city's current position on the issue, this is something we may or may not want to invoke.

    If the city is willing to work with us we may not need to take this route, if the city has made a decision at this point to not work with us and shut down the trails we will exercise this option.


    TCEQ permit- Yes possibly applying for a permit to pump minimal water from the creek for non-potable use if the city is willing to work with us and not shut down the trails to the detriment of the community.

    Additionally, we would only counsel the attorney for ethical unbiased information regarding Flood plain/Flood flow concerns not for representation. - TM

     2. Additionally, one of our volunteers is a Civil Engineer with extensive experience in flood modeling.

    He suggested we may want to file an open records request for the flood model documents used to assess this liability concern with Tejano BMX Trails.

    This would allow him to review the model for accuracy.

    We are using FEMA maps for determination. City Austin previously completed study of Gilleland Creek. I believe we have a  copy of the model. The City is currently working with Halff and Associates to update the model with Atlas 14 rainfall data. We would be happy to provide requested information, if available.- JH

     3. We also have a volunteer who is a licensed Surveyor, who would be willing to survey the trails to provide accuracy in regards to flood modeling evaluation.

     This can be helpful. The City would want to coordinate with the volunteer for this effort.- JH

    The volunteer is a lead surveyor for a licensed survey firm, he is not licensed himself and may have to do the survey independently outside of the firm. I will follow up for details.

    We do have GPS coordinates mapped to Lat/Longs using an iPhone application that provided very accurate data. 

    We have used this to produce a trail map which does show the jump locations in the floodplain image you provided are not 100% accurate.

    The accuracy of the jump locations are crucial in determining the impact on the flood flow modeling. - TM

    4. Another volunteer is friends with a council member who seems to be an advocate for our cause and has agreed to speak with us on this issue.

      I watched the meeting recording and regardless of the outcome, I want to thank you two.

      Realizing you are both advocates for our cause, I want to ask for your guidance to produce the best outcomes given our situation.

      Off the record, please give me your advice to create a win-win situation.

       

      One thing we have on our side is a local volunteer who is a professional civil engineer.

      He has offered to look at the flood modeling.

      The staff notes you provided have the location of the trails further into the flood flow than they actually are.

      This may help our cause.

      All the other issues are easy fixes.

       

      We want to strive to reduce any tax dollars spent on these efforts.

      We made it this far with minimal taxpayer investments and want to keep it that way.

       

      Please know we are 100% willing to acommodate and work with the city.

      We don't want to lose what we have invested so much effort in.

      We hope to work towards a partnership that preserves Tejano BMX Trails for the sake of the community and to eliminate reputation harm to the City of Pflugerville from bad media publicity and negative community response.

      We were able to overcome the exact same concerns presented at today's meeting with the City of Austin to preserve decades of community volunteer efforts at 9th Street BMX.

      Action Items:

      City Stakeholders requested to provide:

      1.   A copy of the document presented at the meeting today.

      2.   Meeting recording.

      3.   A list of attendees and contact information.

      4.   A list of stakeholders involved in this project: General Counsel, Flood Management/Watershed, City Council, etc.

      5.   Any planning/master plan documents.

      Tejano BMX Trails volunteers:

      1.   Removal of concrete fire ring on the concrete foundation that is bordered by 2 foot high concrete walls..

      2.   Removal of water intake system.

      Addressing concerns mentioned in the meeting:

      Erosion:

      ·        Jumps are compacted upon creation and maintained on a daily basis.

      ·        Jumps are tarped to prevent wind and water erosion.

      ·        We actively mitigate erosion of the trails for our benefit as well and soil conservation and flood plain concerns.

      ·        Grass has been planted on the sides and back of all of the jumps to control erosion.

      ·        Silt fencing could be installed to address additional concerns.

      Water Usage:

      ·        Water is gathered from the creek to water storage tanks and applied very sparingly (by hand from garden watering cans).

      ·        There are several residences upstream who implement the same method to water their lawns through irrigation systems vs. by hand.

      Fill:

      ·        No fill has been brought onsite.

      ·        All jumps have been created by manual labor (shovel by shovel) without the use of any machinery.

      ·        The dirt used to build the jumps is dug by hand from the rideable pits between the jumps, this equates to a Zero Net Gain.

      ·        None of the jumps are in the water flow path during a flood, they are all in the flood plain are and do not create blockage to water flow. (supporting visual evidence available)

      Evidence of Community Support:

      We will begin a Community Support Campaign to include an online petition, letters of support, social media support and coverage via local media outlets replicating our efforts at 9th Street BMX.

      We will begin production of a Public Service Announcement (PSA) replicating the PSA used for 9th Street BMX (below)
